Racist prison murder 'avoidable'

The murder of Asian prisoner Zahid Mubarek by a racist cellmate could have been prevented, an inquiry has ruled.

Naming 19 individuals and 186 failings, Mr Justice Keith's inquiry found psychopathic killer Robert Stewart should have been identified as a risk.

Mr Mubarek died in 2000 after being beaten with a table leg in his cell at Feltham Young Offenders' Institution.

Home Office minister Baroness Scotland has written to his family to apologise for his death, their lawyers said.

Family barrister Patrick O'Connor earlier said: "This report is a devastating indictment of our whole prison system."

Inquiry chairman Mr Justice Keith said politicians must fund jails properly or cut prisoner numbers.

Guilty: Mubarek inquiry judge lambasts prisons policy

A High Court judge who led an inquiry into the murder of an Asian teenager killed by his racist cellmate has delivered a devastating verdict on the state of Britain's prison system.

The report into the death of Zahid Mubarek concluded yesterday that the welfare of vulnerable prisoners is being sacrificed by prison overcrowding and under-funding because their cause is not a vote winner.

One of the most far-reaching inquiries into prison practices listed a "catastrophic" range of failures and painted a picture of degrading treatment of inmates, overcrowding, low staff morale, incompetence and indifference to hate crimes.

Mr Justice Keith's report was published on the day it was revealed that the prison population had reached an all-time high of 77,865 in England and Wales, up from 61,000 in 1997 when Labour came to power, and was now close to breaking point.

Mr Mubarek, 19, was fatally bludgeoned by his racist, psychopathic cellmate Robert Stewart on 21 March 2000, just hours before he was due to complete a short sentence for theft. He died a week later later.

The inquiry into the teenager's killing listed 186 separate missed opportunities to save his life and took the rare step of naming and shaming 20 key figures.

Charles Clarke says that the Labour Government has lost its direction. No, it is just not going in Charles Clarke's direction. There has never been a coherent direction for this Labour Government. It has concentrated on power for its own sake and managed image instead of substance.

Today's by-election results show the deep disaffection with this Labour Government. Along with the continuing reports about the "dysfunctional" Child Support Agency, the failures of this Labour Government are obvious everywhere with its deep disaffection.

I have experienced this obsession with power for its own sake directly during the past eight years. Instead of getting the basic job of government done, those in power have done what serves their own self interest with the result that essential services have collapsed creating health and safety hazards impacting everyone for all these years in my direct experience.

Surveillance technology was used against me 24/7 starting in August 1998 to stop me from reporting these serious problems as I sought to get proper government management. My initial complaints and position of eight to ten years ago have been vindicated by what has happened during recent years while the massive attempt to squash me and crush human activity continued. These are being covered in my web journal.

The results can be seen today and in my reporting of the problems as they exist today. The deliberate disregard for providing essential services by government is stunning. Instead, the perversion of the course of justice and extensive criminal activity continue against me with the lethal use of surveillance technology hoping to destroy me and discredit what I report.

I want to tie together my experience with the recent failures in the Home Office relating to the release of the foreign prisoners without consideration for deportation. As was reported yesterday, one of these has killed someone.

This obsession with power for its own sake and image management has permitted the criminal to go free and commit serious crimes as was documented in a release of information yesterday. In my situation the deliberate support of the criminal reported for serious crimes by providing them with surveillance technology to attack the person (me) who reported the crimes is far more serious, yet it derives from the same effort to cover up problems by all concerned including those who wish to project a problem free image.

These serious problems do not go away when they are not properly addressed as Charles Clarke learned with respect to the release of the foreign prisoners into the community without proper procedures. The serious problems which I've been experiencing for eight years have not emerged generally yet, but they will at some point. It's just a question of time. Everyone has been fully informed about them all these years, and still nothing has been done to stop this extensive and deliberate criminal activity on the part of the government.

In the meantime the failures of this Labour Government are turning up daily now and reflect my direct experience. The judgement by the court declaring as unlawful the control orders against six people because such punishment cannot be carried out indefinitely without proper legal proceedings and due process reveals the attitude of this Labour Government in coming up with control orders as an alternative to indefinite imprisonment. Those control orders have been declared unlawful because they violate the Human Rights Act of 1998.

This Labour Government and those in its various departments of government have never respected human rights in my direct experience. The abrogation of human rights in my experience destroys the democratic rule of law and its instutions by the indefinite use of surveillance technology for the purpose of indefinite and unfounded 24/7 imprisonment, torture, interrogation and continuous violence from the lethal use of this surveillance technology which has already caused me serious personal injuries and threatened my life.

This also involves extensive and lethal R&D experimentation carried out against a human guinea pig without consent including medical experimentation deeply involving the NHS. There has been unlawful surreptitious medication administered to me inside my home and anywhere I might be located by various means including the surveillance technology itself. This is unlawful and criminal because it is being surreptitiously administered to a nonconsenting human guinea pig outside a hospital environment. The intent is to cause debility and incapacity in order to manufacture allegations and destroy my reporting of what has been happening.

Institutional murder was the conclusion of a report issued yesterday about the death in 2000 of an Asian youth who was put into a prison cell with a psychopathic white bigot well known for being viciously violent. My direct experience reflects similar activity which I have described as institutional ritual abuse by the sadistic who have been given surveillance technology to carry out attempted murder (so far) 24/7 for almost eight years since August 1998 It goes on as of this writing and has involved scores if not hundreds of people.

There are no standards with respect to this Labour Government. There is only an obsession with power which is reflected at all levels and in all departments of government. My direct experience is alarming in the extreme because it reflects the alternative to respecting and obeying the democratic rule of law. Most important is that it negates the individual responsibility necessary for supporting and maintaining the democratic rule of law. The activity carried out against me is outside the law reflecting vigilante mob action by the criminally sadistic bully to satisfy corrupt self interest: power, greed and glory.

The real danger is that there is no accountability or responsibility for those using this surveillance technology. They can and do get away with whatever they want to do. I believe that this will be the future as this Labour Government meets further frustrations such as has occurred in the last couple days with the declaration that its control orders are unlawful and institutional murder has been carried out on top of the fiasco in the Home Office generally.

This Labour Government will seek to cover up and hide its activities while it seeks to unlawfully, criminally and indefinitely imprison those it does not like subjecting them to extreme, lethal abuse from surveillance technology. Nothing that has happened exposing this abuse of power in other areas in the more publicly known instances has dented the activity being carried out against me in the least little bit. This is why I believe that what is being done to me will become the standard of the future operating completely outside the law without any accountability and responsibility for those who are involved most especially the governments involved.

The US Supreme Court might have ruled yesterday that the military tribunals at Guantanamo Bay are unlawful, but this will have no impact on what is being carried out worldwide by the US Government with its agents involved in this activity in London in conjunction with this Labour Government. These governments will respond like organised crime and just hide their activity more while becoming more threatening to anyone who dares reveal what is going on as I've been doing for years.

The only hope for maintaining the democratic rule of law everywhere along with its institutions is the media which has so far failed to report my experience during all these years despite being fully informed since August 2000. That's almost six years of silence. This is called the crime of silence. In this instance, however, such silence can and will be permanently imposed by these governmets unless they are exposed for what they are doing with respect to this surveillance technology's R&D and its medical experimentation.
