A major part of government legislation to deal with terror suspects has been described as incompatible with human rights laws by a High Court judge.

A Briton given a "control order" by Home Secretary Charles Clarke to restrict his movements was denied a fair hearing, Mr Justice Sullivan said.

He ruled it was "conspicuously unfair" that there was no impartial review of the control orders.

Anti-terror laws are an affront to justice, says High Court

The Government’s anti-terror laws were dealt a devastating blow yesterday when the High Court said that they were an “affront to justice” and breached human rights laws.

Mr Justice Sullivan ruled that the controversial control order system, which keeps terror suspects under a form of house arrest, were “conspicuously unfair”.

The anti-terror laws denied suspects under control orders the right to a fair hearing and were incompatible with human rights laws, the judge said. Although the Government had attempted to apply a “thin veneer of legality” to the measure, suspects’ rights were determined by ministers with no effective oversight by judges, he added.

Terror law an affront to justice - judge. Control orders breach human rights

A high court judge branded the government's system of control orders against terrorism suspects "an affront to justice" yesterday and ruled that they breached human rights laws.

The ruling by Mr Justice Sullivan came after a challenge to the first control order issued against a British Muslim man, alleged by the security services and the home secretary to have been planning to travel to Iraq to fight UK and US forces.

At least 11 control orders have been issued, allowing the government to restrict the liberty and movement of people it claims endanger public safety because of their involvement in terrorism but who can not be tried in the courts.

This decision by a High Court Judge yesterday only reflects what has come before the Court. This Government is manking every effort to circumvent the democratic rule of law, law enforcement, the legal justice system and democratic institutions. This has been my direct experience for the past seven years and eight months 24/7 with the use of surveillance technology as a weapon to imprison falsely based upon a presumption of guilt, punish, torture, interrogate and cause extreme bodily harm with the intent to murder. There are many willing participants in this tenant management environment who willing take the law into their own hands flouting existing standards and laws to carry out the destruction of human activity and life itself. If the judge rules as described above that a fair hearing has been denied, that applies far more to me by the abuse of this surveillance technology which is used to make certain that no fair judicial process even exists. Every effort is made to circumvent the legal justice system. The real question arises as to how is it possible under the circumstances to which I've been subjected since August 1998 for me to bring this into the High Court for a proper, fair and just hearing? The state of the law along with rules, regulations and agencies is hopelessly inadequate at present to deal with the current state-of-the-art of surveillance technology which can use electromagnetic radiation to carry out all the activities I have experience and continuously document and report. The character disposition for people to behave in a malevolent manner remains as it always has being more likely than not to flourish. This is why terrorists exist. The problem is that the Government and those associated with it behave in the same way when they are unrestrained and have the power which this state-of-the-art surveillance technology provides. In short the public is not protected from this abuse of power. The worst aspect is that those using this surveillance technology fabricate whatever they want and nobody is willing to stop them When just a suspicion can be used a means to incarcerate and punish with proper legal proceedings, those with a grudge and driven by hate will just make up what suits themselves against anyone they do not like. There is no legal means under the rule of law and within the democratic institutions of this country to adequately deal with this kind of abuse. In fact, every effort is being made not to abide by and respect these standards which enable society to function properly. Fear of terrorism is being used to sustain power by those who have it at the expense of all that civilisation has developed over centuries of countering such abuses to enable people and society to be protected from them. This is regression by those with limited capacities and abilities who are allowed to come to power and sustain it by methods which will subvert and destroy this society unless it is properly and legally stopped. Terrorism can be effectively addressed, but that is not occurring today because of the abuses which are tolerated and allowed to continue diverting and using resources in situations where a hoax is maintained at the expense of doing a proper job. The devastating aspect of this situation which I am experiencing is the fact that the most sophisticated surveillance technology every known to human civilisation that is capable of getting it right as has never happened before is being abused to such a degree as to cause irreparable social harm. Here's the opportunity for the security services to really do an outstanding job, but instead it is being abuse to satisfy the personal grudges and psychologically demented needs of those who are using the surveillance technology. Once again it's a failure of management including the acquiescence of those who participate and know what is happening to go along with extensive unlawful and criminal acts. Those in positions of responsibility do not act responsible but act expediently instead. Thus, the abuse of power goes on until there is a collapse which is inevitable in such situations. The great tragedy in this current situation and circumstance is that the real criminal, organised gangster and terrorist is allowed to flourish while a large number of people create the illusion of doing something meaningful. The result becomes a terrorist attack like that of last summer which goes completely undetected and succeeds in killing over 50 people and injuring hundreds in London. This will continue until my experience and those who share this kind of experience are able to bring this into the legal justice system for proper public scrutiny of the truth of all that is really going on with respect to this abuse of power.
