Terror raid pair may sue police

Two men released without charge after an anti-terror raid in east London are to take legal action, it is reported.

Abul Koyair, 20, and his brother Mohammed Abdul Kahar, 23, who was shot, will sue the Met, their solicitor Gareth Peirce told the Observer.

Other papers speculate the pair, from Forest Gate, could claim up to £500,000 in damages for their ordeal.

The police have defended their tactics as the Independent Police Complaints Commission investigates the shooting.

Meanwhile Muslim groups are to protest on Sunday against the raid's "heavy-handed" approach.

The men, who had been held for a week under the Terrorism Act 2000 and questioned on suspicion of terrorism involvement, were released without charge on Friday after police found no trace of a chemical device at their home.

The pair had been arrested after a raid by some 250 officers on a terraced house in Lansdown Road, Forest Gate.

Scotland Yard warned MI5 it had serious reservations about the credibility of the source whose information triggered the Forest Gate anti-terrorism raid only hours before police stormed the suspects' house in east London.

Whitehall sources told The Observer last night the reservations were passed up the chain of command to senior officials in the office of Sir Richard Mottram, the government's security and intelligence co-ordinator, but despite the concerns the police were ordered to go in.

'It wasn't the fact that the information was based on a single source, it was more that the police doubted the credibility of that source,' said a Whitehall official. 'The intelligence was doubtful. On the Thursday night [hours before the raid] there were contradictions about how strong the intelligence was.

'There came a point when officials in the Cabinet Office were made aware that the police believed they were being placed in difficulty because of the quality of this intelligence.'

The revelation comes as the News of the World today publishes details of a leaked copy of the Independent Police Complaints Commission report into the tragic shooting of the innocent Brazilian Jean Charles de Menezes at Stockwell station, south London, last July in the wake of the London tube and bus bombings.

THE News of the World last night fought off a bid by police watchdogs to stop us revealing the sensational truth about the shooting of Brazilian Jean Charles de Menezes.

The leaked Independent Police Complaints Commission report shows a catalogue of blunders and cock-ups. The dossier is so damning it appears to spell the end for Met chief Sir Ian Blair.

the IPCC appealed to a judge to stop our story being published. But Mr Justice Gray threw out their application for a gagging order.

Our lawyer Tom Crone said: "IPCC lawyers tried to gag us on the basis of confidentiality but failed."

BELEAGUERED Scotland Yard boss Sir Ian Blair was last night fighting for his job—after being exposed over a fresh catalogue of cock-ups surrounding the tragic shooting of Brazilian Jean Charles de Menezes.

The top-secret Independent Police Complaints Commission report into the scandal, leaked yesterday to the News of the World, sensationally reveals a raft of incompetence, blunders and buck-passing that seem to spell doom for the Metropolitan Police Commissioner.

Last night we beat off an attempt by the IPCC to stop us publishing revelations in the 150-page dossier. Mr Justice Gray refused to grant a gagging injunction to the police watchdog.

The dossier, leaked by Whitehall insiders, reveals that some of Sir Ian's senior officers KNEW de Menezes was innocent and definitely NOT a suicide bomber just hours after he was killed. But they failed to tell their boss until the next day.

The police are caught in the middle of a double bind: damned if they do and damned of they don't. The police are everyone's favourite whipping post because they cannot say anything. Confidentiality about all police business must be maintained for the sake of securing the public safety in everything they do. The police have this extra and quite special management burden like no other organisation. Everybody looks to the poplice for help, and everyone blames the police when things go wrong. For this police it's always a no win situation even when they get it right.

In a fundamental sense the police are not masters of their own house and must do the bidding of those who are in control. They must carry out actions against their better judgement and are kept from actions which are necessary. They have to please everyone. They have to be all things to all people. No organisation can do this, and it is special problem for the UK given its government structure. The problem arises when the fundamental standards of the democratic rule of law are abrogated by those who can determine what the police do.

I have watched the abuse of the police for the better part of eight years in the most amazing situation possible which beggars belief and boggles the mind. It is too easy to complain about the police as has occurred in my direct experience. I have directly experienced the fabriations of allegations by those who want to manipulate the police to participate in a criminal harassment activity. At the same time I have directly witnessed those in the police participating in this fabricating activity while deliberately carrying out extremely abusive torture and criminal harassment. This is the complicating factor that makes the police look bad from my direct experience when it might not be the case at all when seen in a larger context.

By this I mean that there are rogue elements in the police most likely connected with Special Branch that carry on in a very abusive and destructive manner making it difficult if not impossible for the vast majority of the police to do a proper job of law enforcement. These rogue elements extend to the security services, the Home Office and the government itself including local government. When the police try to please everyone in situations where they are being abused and must do their job, the police then turn up as the whipping post while the real source of the problem remains hidden.

In September 1999 I sent a 50-page letter by fax and post to the Prime Minister which finally settled in the Home Offce. The letter I received in response noted that I had raised several issues and suggested that I complain about the police if I wished providing information on how to do so. I thought that this was a deflection from the real issues about the failure to address child abuse which I was raising. This involved several departements of government and also including surveillance against me the person who had reported the child abuse carried out by those involved in the child abuse.

I did not want to be distracted and bogged down with a complaint about the police in a situation where I could not possibly obtain information about police activity. My letter was sent simultaneous with the killing of Victoria Climbie and brought up the same type of child abuse problems. After I sent this letter, the abuse against me escalated in a most phenomenal way because those using the surveillance technology were able to see and read all that I did. The retaliation by means of escaluation started during the writing of this letter and continued at a higher plane involving more people and different departments of government.

What followed most certainly justified a complaint against the police, but they were just carrying out as instructed actions based upon false allegations which also involved different government departs and a large number of people. For a month from mid-December 1999 until mid-January 2000 I was subjected to what amounted to a 24/7 police seige to remove me from my home. Every imaginable surveillance technology was used with a massive police presence summoned over and over including the Fire Brigade and an ambulance which are required during such removals by force and most likely violence.

I won't go into the details of this here, but will note that it went on over Christmas itseld and throughout the holidays without any let up. Finally, it was stopped because the police said it was costing too much money. Some group or groups of people were abusing the police. Any complaint that I might have would have to go to the source of the problem and those responsible. The police at this point were part of this and in some sense on the periphery of the central problem.

In subsequent years thousands of calls went out summoning the police to respond as if there was an emergency when there was none at all. The reasons for the call out were farcical and risable but reflected an abuse of the police which became quite complicated. These false emergency calls made not only to the police but to the Ambulance Service and Fire Brigade put the public at risk from the responses themselves and from removing the emergency services from legitimate calls.

The situation has become very complicated from the point of view of those responsible for providing for the protection of the public's safety and health, but in reality it is quite a simple situation of abuse by those who were reported for child abuse anothers who were reported for other crimes along with antisocial behaviour. It is only complicated because of the emotionally hysterical bullying from those using the surveillance technology fabricating allegations that are totally false and cannot be validated by anyone else for almost eight years. The hysterical behaviour of those who scream and bellow continuously making up atrocious allegations and negative characterisations is supported and sustained.

This is why the problem does not rest exclusively with the police. It rests with whoever has been allowing this situation to continue for all these years. The police have tried to stop this activity with no success. It appears to me that that police do not have the ability to stop something that is clearly criminal and against all the standards and values which the deocratic rule of law represents. The police themselves as I can see it are as much a victim of abuse from those who can compell them to not enforce the law and allow extensive criminal activity to contine for many, many years 24/7.

As can be seen in the news reports above, there was doubt about the validity of the information supplied by the source which ultimately brought out this Forest Gate terrorist raid using some 250 police officers including the shooting of one suspect and the destruction of their home resulting from the week long search. In my situation observers witness repeatedly that the allegations being made are false. I document and report them as such. Lt Harry Bird and those with him including the mother of the abused children make up whatever they want to sustain the surveillance abuse and are permitted to do so. It is done out of a desperate effort to cover up their criminal abuse of surveillance technolopgy.

I see many similarities between my experience during all these years and the violence erupting now from the police including the Forest Gate raid and murder of the Brazillian. The kind of violence which created these very prominent and well publicised problems is the same kind of violence which has been carried out against me for years. I believe that this derives from rogues connected with the police and the fact that the police are not masters of their own house. The abuse of the police comes from somewhere outside the police. The solution is to rigorously inquire into all aspects of this kind of abuse to root out the rogues, establsh standards and determine authority and procedures for dealing with information which might be bogus in order to better protect the public safety. There should not be a knee jerk reaction condemning the police until a full, fair and judicial inquirty can be carried out.

Muslims have protested outside Scotland Yard against the "heavy-handed" tactics behind an anti-terrorism raid.

The Muslim Association of Britain and the Islamic Human Rights Commission are among Muslim groups represented.

Brothers Abul Koyair, 20, and Mohammed Abdul Kahar, 23, who was shot in the shoulder, were released without charge a week after the raid in east London.

The police have defended their tactics as the Independent Police Complaints Commission investigates the shooting.

Organisers said about 1,000 people had joined the protest on Sunday, while police put the figure at closer to 100.

The brothers, who had been held under the Terrorism Act 2000, were released on Friday after police found no trace of an alleged chemical device at their home.
